Terms & Conditions

Please ensure that you read and understand these Conditions before you agree to be bound by them (in particular Clause 3 & 8)

1. Definitions and Interpretation

1.1 In these Conditions, the following terms shall have the following meanings:

  • Contract means any contract for the sale of Goods and/or the supply of Services between us and you into which these Conditions are incorporated;

  • Conditions means these standard terms and conditions of sale, including the Returns Policy and any special terms and conditions expressly confirmed in writing by us;

  • Goods means the goods and/or services which we shall supply in accordance with these Conditions, pursuant to an accepted order;

  • Returns Policy means the standard terms and conditions applicable to the return of Goods by you, as set out in our Returns Policy, which is incorporated into these Conditions by reference;

1.2 Working Days means Monday to Friday, 10:00am to 5:00pm (UK time), excluding bank, public and statutory holidays;

1.3 References to we, us, or our shall mean Barucci Custom Tailors, and references to you or your shall mean the person placing an order and entering into the Contract with us;

1.4 The headings in these Conditions are for convenience only and shall not affect their interpretation;

1.5 Unless expressly stated otherwise, where any right or decision is to be exercised or made at our sole discretion, we shall have no obligation to justify or provide reasons for such decision;

1.6 Where our prior written consent is required under these Conditions, such consent shall not be unreasonably withheld or delayed;

1.7 All rights expressly reserved by or granted to us under these Conditions are without prejudice to any other rights we may have at law or in equity;

1.8 We reserve the right to amend these Conditions from time to time as necessary.

2. Basis of Sale

2.1 These Terms (as amended by us from time to time) represent the complete agreement between you and us. No changes will be binding unless confirmed by us in writing and attached to this agreement. Your purchase will be subject to the terms and policies in place at the time of order, unless a legal or regulatory change requires otherwise—in which case such changes will also apply to any existing orders. These Terms govern all purchases made from us, regardless of the ordering method.

2.2 Our employees or agents are not authorised to make representations about the Goods unless confirmed by us in writing. By entering into this Contract, you confirm that you have not relied on any statements not officially confirmed in writing.

2.3 If Goods are delivered in instalments, each instalment shall be treated as a separate contract. A failure to deliver one instalment does not permit cancellation of the remaining ones.

2.4 All specifications, measurements, illustrations and performance details provided by us are approximate and intended for general guidance only.

2.5 We reserve the right to withdraw or amend any promotional offer at any time without notice. If you have already placed and we have accepted an order under such a promotion, we will refund any payments made in full should the offer be withdrawn.

3. Orders and Specifications

3.1 Your order is an offer to purchase Goods, which we accept only when we send written confirmation. Orders must be for personal use only—not for resale. By ordering, you confirm you are at least 16 years old. All orders are subject to availability and processed on a first-come, first-served basis. We reserve the right to decline any order.

3.2 If we reasonably suspect you intend to resell the Goods (via a shop, online platform, or otherwise), we may reject your order. If we proceed, we reserve the right to treat you as a commercial buyer and:
3.2.1 withdraw the cancellation rights under Clause 10;
3.2.2 revoke our standard Returns Policy;
3.2.3 accept returns only within 7 days of dispatch, and only if the Goods were defective on arrival;
3.2.4 apply a handling fee (excluding packaging/delivery), which will be confirmed before acceptance;
3.2.5 amend these Terms as appropriate, and proceed only upon your agreement.

3.3 You are solely responsible for ensuring the accuracy of your order details and providing all required information in time for us to fulfil your order. We are not liable for costs arising from errors you submit, or from issues such as mobile network failures when ordering by phone.

3.4 If Goods are manufactured or processed to a specification you provide: (1) Clause 10 (Your Right to Cancel) does not apply; (2) you agree to indemnify us against all liabilities or claims related to intellectual property infringement resulting from your specification; and (3) we reserve the right to amend your specification as needed to comply with applicable laws or regulatory requirements.

4. Price of the Goods

4.1 The price of the Goods shall be as confirmed by us at the time your order is placed.

4.2 Although we aim to ensure all prices listed on our website are correct, errors may occasionally occur. If we discover a pricing error—whether due to our mistake or a third party's—we will contact you promptly. You may then choose to reconfirm your order at the corrected price or cancel it. If we cannot reach you, the order will be treated as cancelled and a full refund issued if payment has already been made.

4.3 If we are unable to supply the Goods at the stated price or specification, we will inform you where possible. If the original item is unavailable, we may offer substitute Goods. You will have the option to reconfirm your order at the revised price/specification or cancel it. If you reject the substitute, you are entitled to a full refund.

4.4 Any delivery or packaging costs for which you are liable will be confirmed before your order is placed.

5. Terms of Payment

5.1 Please refer to our Payment Options for full details on accepted payment methods and terms.

5.2 If you fail to make payment by the due date, we may: (a) cancel the Contract or pause further deliveries; and (b) charge interest at 3% above the NatWest Bank base rate, calculated daily from the due date until full payment is received.

5.3 If your cheque or card payment is declined, and we incur fees as a result, you agree to reimburse us for those charges in full.

5.4 All card transactions are subject to standard checks and authorisation by the card issuer. If your payment is declined, we’re not liable for delay or non-delivery. To prevent fraud, we may validate your identity and address using trusted third-party services (e.g., credit reference agencies). By placing an order, you consent to these checks, which may involve contact via phone, post, or email. Any data shared will be handled per the Data Protection Act 1998.

6. Delivery

6.1 You are responsible for making all necessary arrangements to receive the Goods when delivery is attempted.

6.2 We aim to provide an estimated date for delivery or collection. If delays occur, we’ll notify you and share a revised date. However, we are not liable for any direct or indirect loss caused by delivery delays. Delivery times are not guaranteed unless explicitly agreed in writing. We may deliver earlier than estimated with reasonable notice.

6.3 If we fail to deliver (excluding causes beyond our control or your fault), our liability is limited to the difference between what you paid and the lowest available market cost of equivalent goods.

6.4 If you instruct us or our delivery partner to leave Goods in a “safe place” or provide other special instructions, you accept full responsibility for any resulting loss or damage.

6.5 If delivery cannot be completed to the billing or agreed address within 90 days, or after three failed attempts due to your actions or inactions, we may cancel the Contract and refund you at our discretion.

6.6 If you fail to accept delivery or do not provide clear delivery instructions, we may store the Goods and charge reasonable costs for storage and redelivery, including insurance.

6.8 If delivery is outside the UK, you are responsible for all customs duties, import taxes, and compliance with local regulations. We are not liable for customs delays or additional charges.

7. Risk and Ownership

7.1 Risk of damage to or loss of the Goods passes to you at the point of delivery (excluding our premises), or—if you fail to accept delivery—at the time the Goods are made available for collection.

7.2 Ownership of the Goods remains with us until full payment has been received and cleared. Risk passes upon delivery, but title passes only upon full settlement.

7.3 If you fail to pay in accordance with these Conditions, we may require you to return the Goods. If you fail to do so, we reserve the right to seek a court order to enter your premises and repossess them.

8. Warranties and Liability

8.1 Unless you are buying as a consumer, all warranties, conditions, or terms implied by law are excluded as far as the law allows.

8.2 If you're purchasing as a consumer, your legal rights remain unaffected. You can get advice about these rights from Trading Standards or Citizens Advice.

8.3 Our warranty does not cover faults caused by normal wear and tear, misuse, accidents, negligence, failure to follow instructions, or unauthorised alterations or repairs.

8.4 If the Goods are faulty or not as described, let us know promptly. We’ll either:
(a) refund you in full or in part,
(b) repair the Goods, or
(c) replace them—after inspection and at no cost to you.

8.5 Except as stated below, neither of us is responsible for losses unless they were reasonably foreseeable at the time of the contract.

8.6 We are not responsible for losses such as lost income, profits, business, expected savings, data, or wasted time—unless it involves damage to your physical property due to our fault.

8.7 Nothing in these terms excludes or limits our liability for death or injury caused by negligence, fraud, or other liabilities that cannot legally be excluded (e.g. under the Sale of Goods Act 1979, Supply of Goods and Services Act 1982, or Consumer Protection Act 1987).

9. General Terms

9.1 Neither of us will be responsible for delays or failures to meet obligations if caused by events outside our reasonable control.

9.2 These terms do not give any rights to anyone other than you or us.

9.3 Any notices must be sent in writing (including by email) to the contact details provided in the order or any updated ones we give each other.

9.4 If we don’t act on a breach right away, that doesn’t mean we waive our right to take action later.

9.5 If any part of these terms is found to be invalid or unenforceable, the rest remains fully valid.

9.6 These terms are governed by the laws of England and Wales. Any disputes must be handled in English courts.

9.7 We may monitor and record phone calls to check staff performance and improve customer service.

9.8 All photos, images, and product descriptions on our website belong to us or our suppliers. You may not copy or use them without our written permission.

9.9 All dealings between us will be in English.

9.10 You may not transfer your rights under these terms without our written consent (which we won’t unreasonably refuse). We can transfer our rights to another organisation without affecting your rights.

10. Your Right to Cancel

10.1 If you’re unhappy with the Goods, you can cancel your order within 14 calendar days from the day you receive them. 

10.2 If you want to cancel before we dispatch the Goods, please contact us as soon as you can by email, phone, or via our online form.

10.3 If you want to cancel after dispatch, please return the Goods to us as soon as possible, telling us if you want a refund or an exchange. For exchanges, we recommend placing a new order separately because stock may run out while we process your return. You must take reasonable care of the Goods while you have them. If you don’t, we may seek compensation. See our Returns policy for details.

10.4 Please note that the right of cancellation does not apply where Goods are specifically made to your specification or personalised at your request. This expressly includes, without limitation, bespoke garments, made-to-measure garments, made-to-order garments, and any Goods which have been customised, tailored, monogrammed, or otherwise personalised at your express request, and accordingly, once production has commenced or personalisation has been undertaken, you do not have a right to cancel or return the Goods under the standard cancellation provisions. Please ensure that you are satisfied with all specifications and customisation instructions prior to confirming your order.

11. Promotional Codes

11.1 We may, at our sole discretion, provide promotional codes to customers from time to time. Such promotional codes shall only be used by the person to whom they are issued and are limited to a single use unless expressly stated otherwise.

11.2 Promotional codes may not be used in conjunction with any other offers, discounts, or promotions unless expressly stated.

11.3 No cash alternative or exchange shall be offered in respect of any promotional code.

11.4 We reserve the right to withdraw, amend, or refuse any promotional code at any time without prior notice.

11.5 Promotional codes shall only be valid on confirmed orders, except where otherwise explicitly stated.

11.6 Promotional codes may not be applied to postage, packaging, or delivery charges.

11.7 Promotional codes shall expire after the date specified and shall not be accepted thereafter.

11.8 Promotional codes must be submitted and applied at the time the order is placed. We shall not be obliged to apply any promotional code to an order submitted without it. Customers are advised to check their order carefully before finalising.

11.9 Where a promotional code is applied, any returns or refunds shall be calculated proportionally based on the discounted price shown on the sales invoice.

12. Competitions

12.1 We may, at our sole discretion, offer competitions to customers from time to time, conducted in such manner and on such terms as we deem appropriate.

12.2 All prizes offered are non-transferable and no cash or other alternative shall be offered in lieu of the stated prize.

12.3 Unless otherwise stated, entry to any competition is limited to one entry per person per residential address. We reserve the right to disqualify any duplicate or multiple entries at our discretion.

12.4 Unless otherwise specified, there shall be only one winner per competition, selected by random draw following the closing date.

12.5 Our decision in respect of the competition winner shall be final and no correspondence shall be entered into.

12.6 Winners will be notified by email using the contact details provided at the time of entry.

12.7 Prizes shall be dispatched to the winner’s nominated address at our cost. Winners must provide any information reasonably required to facilitate delivery of the prize as soon as practicable.

12.8 Employees, agents, representatives, and their immediate families of Barucci Group and its associated companies are not eligible to enter competitions.

12.9 Participants are advised to read the full terms and conditions of any competition carefully before entering.

13. Multibuys

13.1 We may, at our sole discretion, offer multibuy promotions. Such promotions may entitle you to receive one item free, the lowest priced item free, or a reduced price on qualifying items, provided you purchase at least the minimum number of items stated in the promotion within a single transaction. We reserve the right to amend or withdraw any multibuy promotion at any time without prior notice.

13.2 Multibuy promotions are not available in conjunction with permanently reduced or sale items.

13.3 We reserve the right to withdraw or amend any multibuy promotion at any time without notice.

13.4 No cash alternative will be offered in respect of any multibuy promotion.

13.5 Should you request an exchange or refund of goods purchased under a multibuy promotion, all qualifying items forming part of the promotion must be returned. The free or discounted item is not eligible for refund, either in cash or credit.

13.6 In cases where your original purchase included a multibuy promotion or promotional discount code, refunds will reflect the adjusted price allocation. Accordingly, the refund value of individual items may differ from the original sale price.

14. Suit Promotion Packages

14.1 Suit package promotions may include complimentary items such as shirts, ties, or other accessories. These promotional items must be added to your basket prior to checkout to qualify. We are unable to add promotional items to your order after it has been placed, and such items cannot be added subsequently.

14.2 If only part of a suit promotion package is returned, the promotion will be considered void. The refund will be calculated by proportionately charging the full retail price for the retained items, with the refunded amount reflecting the adjusted price of the returned items accordingly.

14.3 The offer applies solely to jackets and trousers. Waistcoats may be purchased separately as an optional extra and are not included in the promotion.
